Standard service disruptions are compensated via Point Injections or Prime Node Time Extensions. Monetary refunds are evaluated only in cases of catastrophic, unrecoverable system failure.
Subscriptions are non-recurring. Access to the service will expire automatically at the end of the subscribed period without automatic renewal. No partial refunds are issued for unused subscription time or remaining Compute Points.
Upon subscription expiration, a 72-hour grace period applies. After T+72hrs, all nodes automatically revert to Base Node defaults. Monthly quotas reset at 00:00 UTC. Purchased Point Injections are consumed only after monthly quotas reach zero and do not reset monthly.
Filing an unjustified chargeback or payment dispute with a bank or payment processor without prior 30-day written notice to SIMAIC constitutes a material breach, except where such rights are expressly granted by applicable consumer protection laws. Such actions will result in immediate and permanent account termination.

Your telemetry and webhook payloads are processed securely. We do not intercept your private endpoint data to train public foundation models. All retained telemetry data is encrypted at rest using industry-standard protocols (AES-256).

If your payloads trigger a violation at the upstream provider that jeopardizes the SIMAIC master API key, you are solely responsible. The following operations are strictly prohibited:
Violation of the AUP bypasses all grace periods. The system will forcefully terminate your Node, zero out remaining Points, and permanently blacklist your origin domain. Any remaining subscription value may be forfeited to the extent permitted by applicable law.
If user behavior results in the suspension or banning of SIMAIC's upstream API keys (e.g., OpenAI, Anthropic), the user shall be held fully liable for all resulting damages, including but not limited to business interruption losses.

Service Termination: In cases of AUP violations or fraudulent activity, termination may be immediate and without prior notice. In all other cases, we will provide reasonable advance notice where practicable.
Minor Users: If a user under the age of 18 accesses this service, their legal guardian or parent is deemed to have read, understood, and agreed to these Terms on their behalf, and shall assume full legal responsibility for such use.
Mandatory Negotiation: Before initiating any formal legal action, both parties agree to first attempt to resolve the issue informally by providing written notice to SIMAIC and allowing a mandatory 30-day negotiation period.
Governing Law: These terms shall be governed by the laws of Taiwan (R.O.C.). Any disputes shall be subject to the exclusive jurisdiction of the Taipei District Court.
Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Amendments: SIMAIC reserves the right to modify these Terms at any time. Users will be notified of material changes via email or an in-platform notice at least 14 days prior to the effective date. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
Language & Comprehension: This document is executed in English. By utilizing SIMAIC, you explicitly acknowledge possessing sufficient English proficiency to fully comprehend these Terms.

This service is strictly not directed to, nor available for, users located in the European Economic Area (EEA), the United Kingdom (UK), or the People's Republic of China (PRC).
If you are located in these jurisdictions, you are not permitted to register or utilize this service. SIMAIC reserves the right to block accounts and API requests originating from these regions without prior notice.
